Terms of Service

1. Agreement to Terms

By installing, accessing, or using Recital Flow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a school, music conservatory, academy, or educational institution, you represent and warrant that you have the authority to bind that institution to these Terms.

2. Description of the Service

Recital Flow provides concert orchestration software natively integrated with the Google Workspace™ platform. Features include automated Google Forms™ registration forms, multi-piece performance management, automatic timeline calculation, Google Slides™ presentation exports, audio track packaging, PDF program booklets, and live public schedule broadcasting.

3. User Responsibilities, Content Rights & Public Schedules

• Content Ownership: You and your institution retain all rights, title, and ownership to all student records, audio files, sheet music PDFs, logos, and presentation decks processed through the Service.
• Live Public Schedules (AWS Serverless): When an organizer enables the Live Public Schedule feature, only the masked lineup (student name mask, piece title, instrument, and performance time) is cached on Amazon Web Services (AWS) serverless edge infrastructure to provide low-latency viewing for concert attendees. No private student emails, parent contact records, or raw files are ever broadcast.
• Student Privacy & Masking: Organizers are responsible for selecting appropriate privacy masking formats (e.g. First Initial + Surname or Initials Only) in compliance with institutional child privacy policies and applicable regulations (e.g. FERPA, COPPA, GDPR-K).
• Automatic Cloud Purge on Deletion: Deleting or unpublishing a recital from the Director's Console dispatches an immediate delete command that permanently purges cached schedule records from the AWS cloud infrastructure.
• Copyright Compliance: You are responsible for ensuring that any musical compositions, backing tracks, sheet music scores, and audition video links uploaded or linked by your performers comply with relevant copyright and performance licensing regulations.

4. Free & PRO Memberships

The Service is offered under Free and PRO tiers:

Subscriptions renew annually unless cancelled prior to the renewal date. Subscriptions are billed securely through Stripe.

5. Intellectual Property & Demo Assets

Recital Flow and its underlying scripts, designs, trademarks, and documentation are the intellectual property of the service providers.

Demo musical assets included within the application for testing (e.g. the musical composition "Isolation" © P. Cain) are used under express license and permission from the copyright holder and remain the property of their respective creators.

6. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED AVAILABILITY OR ERROR-FREE OPERATION OF THIRD-PARTY PLATFORMS SUCH AS GOOGLE WORKSPACE, GOOGLE DRIVE, OR STRIPE. IN NO EVENT SHALL RECITAL FLOW BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM USE OF THE SERVICE.

7. Modifications to Service & Terms

We reserve the right to modify these Terms or update application features to enhance functionality or ensure ongoing compliance with Google Workspace™ policies. Continued use of the Service following any changes constitutes your acceptance of the revised Terms.
